Legal process is an intimidating, complex system that many people find challenging to navigate. We believe that a lack of knowledge and awareness about legal services is one of the major barriers preventing clients from engaging their lawyers. Legal processes and procedures are reportedly described as "black boxes". Our goal in this blog post is to present the findings from our study with lawyers and clients in order to better understand how marginal legal knowledge affects the decision making processes when people need assistance with family, employment, or housing issues. No doubt, there is a shortage of legal services available to poor and low-income individuals. We are confronted with the loss of law's effectiveness today, when many of its users do not even comprehend the role law plays each day in their business, in their lives. Our mission is to play a critical role as intermediaries between the law and the people, figures who have the knowledge, skills and trust necessary to resolve disputes, move past deadlocks, dispel tensions, and otherwise bring people and resources together in beneficial ways. Empirical research suggests that more salient problems could be “lack of awareness or understanding that a problem is legal in nature, lack of belief that a lawyer could help, embarrassment, perceived futility, fear, and resignation.” (Dana A. Remus, “Reconstructing Professionalism,” University of North Carolina Legal Studies Research Paper No. 2676094 (Chapel Hill: University of North Carolina, 2015), 6.) A Contracts Audit An audit of a contract has as one of its primary objectives the identification of issues before they arise as problems, disputes, and costs. An audit of your legal records can provide you with information regarding your company's current position, as well as your projected position for the upcoming year. You will learn: What clients you should lose and which clients will leave you? Is there scope to win more work from the same well i.e. a happy client? You might be able to generate some liquidity by following up on payments or invoicing for unpaid work. Did your big clients also make you money? If a contract is about to end, what actions can you take to 'keep this client'? What is needed? Provide workable knowledge and establish processes that enable organizations to manage risks, compliance, and contracts even without an internal legal department. Offer more than technical expertise; provide human assistance to help SME companies implement legal advice.
